I. About These Terms
This document (Terms of Service) outlines the terms and conditions under which our law firm supports clients worldwide in matters related to Polish citizenship. It applies both to services offered via our website lexmotion.eu, and to those provided directly by Lexmotion Law Firm, led by Attorney at Law Małgorzata Magierska, operating under the name Lexmotion Kancelaria Radcy Prawnego Małgorzata Magierska. It transparently describes all the steps involved in confirming or restoring Polish citizenship, as well as additional services such as registration of foreign civil records, recognition of foreign divorce decrees, or administrative name & surname changes. It also outlines the respective responsibilities of both parties — yours and ours — at each stage of the process.

IV. What we offer
Our Terms of Service reflect the full scope of legal assistance we offer, including both our core service — confirmation of Polish citizenship by descent — and a range of complementary or standalone services related to Polish civil status and identity documentation. These services include:
- Free Polish citizenship eligibility check (section V) – a no-fee survey that helps you determine whether you may be eligible to confirm your Polish citizenship by descent.
- Free Polish documents analysis (section VI) – an initial review of your existing Polish documents to assess whether they are sufficient to apply for a Polish citizenship certificate.
- Polish document search (section VII) – a paid service for locating missing records in Polish archives to support your citizenship application.
- Assistance with confirmation of Polish citizenship by descent (sections VII and VIII) – a comprehensive, multi-step legal service aimed at obtaining your Polish citizenship certificate.
- Preparation and delivery of documents for Polish passport application (section IX) – we provide you with a complete, ready-to-submit package for your appointment at the Polish consulate.

All services are provided remotely, based on information and documents you submit, and in accordance with the applicable Polish legal procedures.
V. Free Polish Citizenship Eligibility Check
The free eligibility check is the first thing you’ll experience when you visit our website.
It starts with a no-fee survey you can take literally everywhere, as it is mobile ready.
You answer questions about yourself and your ancestors, and provide your contact details – your name, surname, and email address. (To learn more, please see our Privacy Policy.)
You also inform us whether you already have your ancestors’ Polish documents or would like us to search for them in the appropriate Polish archives.
We review your answers and, within two business days at the latest, we send you an email with the result and guidance on the next steps to obtain Polish citizenship by descent.
*Important – What could cause loss of Polish citizenship
We conduct your Polish citizenship eligibility check based on the information you provide through our website or via email. Please note that any incorrect or incomplete information may affect the outcome of the assessment. Your eligibility check confirms your right to Polish citizenship by descent only if neither you nor your Polish ancestors have formally renounced Polish citizenship. Renunciation of Polish citizenship is a rare occurrence and can only be carried out before a Polish authority, such as a Polish consulate. If the Polish authorities refuse to issue a Polish citizenship certificate on the grounds that you or your ancestors renounced Polish citizenship, please understand that this is beyond our control. If you have any doubts about whether your ancestors may have renounced their Polish citizenship, it is important that you verify this carefully and inform us of any such circumstances.
Your Polish citizenship eligibility check confirms your right to Polish citizenship by descent only if your Polish ancestor(s) haven’t declared non-Polish nationality before any, Polish or non-Polish authority.
Obtaining Polish citizenship may not be possible if you or your Polish ancestor(s) lost Polish citizenship due to international agreements signed by Poland in the second half of the 20th century. These agreements regulated the citizenship status of people with dual citizenship and could result in the automatic loss of Polish citizenship.
We recommend that you verify this information with your family, as they may be aware of any past declarations or citizenship changes. If needed, one of our consultants can assist you in assessing the situation.
Poland signed such agreements with the following countries:
- USSR – agreements signed in 1958 and 1965, affecting persons from territories of today’s Armenia, Azerbaijan, Belarus, Estonia, Georgia, Kazakhstan, Kyrgyzstan, Latvia, Lithuania, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan
- Hungary, in 1961
- Czechoslovakia (now Czech Republic and Slovakia), in 1965
- Bulgaria, in 1972
- Mongolia, in 1975
- German Democratic Republic (GDR / East Germany), in 1975
These agreements may apply even if your ancestor did not personally renounce their Polish citizenship. If your family lived in one of these countries, or moved there after WWII, please let us know at the eligibility check stage.
Please also inform us at the eligibility check stage if any of your ancestors — including those not from your Polish line — were born in or lived in any of the above-listed countries.
We also recommend discussing this with your family, as they may know of any such connections. If needed, our consultants can help assess how this may impact your case.
In some cases, traveling through various countries between 1920 and 1951, acquiring foreign citizenship, or serving in a non-Polish military force may also impact the Polish citizenship status of you or your ancestors.
VI. Free Polish Documents Analysis
Free documents analysis is what you experience when you inform us via lexmotion.eu that you have some Polish documents.
We ask you to send us their photos or scanned copies. Then we confirm whether they are sufficient to prove your right to Polish citizenship by descent.
If your collection of Polish documents is incomplete, we provide an efficient Polish Document Search service (go to section VII).
If your Polish documents are sufficient to claim your Polish citizenship, we offer you our assistance in the procedure of confirmation of your Polish citizenship (go to section VIII).
*Important – Why your documents might be insufficient
Your Polish documents proving your or your ancestor’s Polish citizenship (such as Polish passports, etc.) may, in very rare cases, have been issued by Polish authorities without a proper legal basis. As a result, the authority handling your case may deem them insufficient and request additional documentation. In such cases, we will search for the required documents on your behalf in the relevant archives.
During the procedure for confirming your Polish citizenship, the Polish authority may uncover additional information or documents related to you and your family and may request further explanations or supporting materials. In such cases, we will search for the necessary documents on your behalf in the relevant archives.
VII. From Polish Document Search to Polish Citizenship
You can hire us to search for your missing family’s Polish documents. Here are all the steps of Polish document search and the procedure of confirmation of Polish citizenship by descent:
- FWe begin by sending you an email with a few simple questions necessary to start Polish document search.
- The information you have provided is initially reviewed by our Sales Team, who assess whether additional services — such as Polish documents search — may be necessary in your case. Please note that this assessment is not a legal analysis, but rather a service recommendation based on the documents and information you provided; once you decide to proceed and the service is ordered, your case is handed over to our Documents Search Experts for further processing.
- You receive an offer via email detailing our fee for the Polish document search and assisting you in the procedure of confirmation of Polish citizenship by descent. You can then decide whether to proceed with the payment. You have one month to make this decision, as our offer will remain valid for this period. Note that the family discount is subject to change based on the pricing policies in effect at the time any additional family members are added to the procedure.

If essential details such as names, dates, or places of birth or marriage are inaccurate, this may lead to delays or failed searches. For example, if we search in Kraków based on your input, but later you inform us the ancestor was actually born in Łódź, we may need to restart the search from the beginning. In such cases, we reserve the right to reprice the service, as it requires the same resources and time as a new search. - By choosing our service and making the payment, you accept these Terms of Service. The payment should be made securely using:
- Stripe or PayPal,
- credit card (processed by Stripe or PayPal),
- bank wire transfer.
Please note that the total amount due may be adjusted to include VAT, depending on your tax residency at the time of payment.
- An authorization document is sent to you via email. By signing it and sending it back to us, you authorize us to represent you or other members of your family. Along with the authorization you will receive a list of non-Polish documents with a detailed instruction on how to get them. Please note that the authorization must be printed, signed by hand, and sent to our office as a hard copy — scanned or digital signatures are not accepted.
- We may ask you to provide documents such as birth or marriage certificates, a death certificate of your ancestor, or a scan of your current passport, if needed to prove your relationship to the person whose documents we are searching for, as required by some archives.
- Please remember that we can only move forward once we receive your signed authorization and non-Polish documents. Ideally, we recommend sending them within 1 month of payment – this helps keep your case moving smoothly. We’ll wait up to 4 months in total. If we don’t get them from you within that time, we may assume you’re no longer interested, and we may close your case and withdraw the authorization. In such a case, we won’t be able to refund the fees already paid. This part of the fee covers the work we’ve already done based on the data you provided. If you decide to resume your case after this 4-month period, you will need to pay the first installment again at the current price in order to reopen the case and continue our services.
- As soon as we receive the signed authorization and other relevant documents (if necessary) we begin the document search. We send requests to all the relevant archives.
- Our Polish document search service focuses only on locating documents issued by Polish authorities that confirm Polish citizenship and are required for the citizenship confirmation procedure. This service does not include searching for non-Polish documents (such as foreign birth or marriage certificates), nor does it cover broad genealogical research or the retrieval of all documents related to your family available in Polish archives. You’ll need to obtain those yourself, based on our instructions.
- You will receive a list of archives in which the document search will be conducted.
- You will be regularly updated about the progress.
- Polish document search takes 3 – 6 months on average.
*Important – Why it can be hard to find your Polish documents
Polish archives are not digitized, and in some cases, specific records may be unreadable, lost, or — in very rare situations — affected by an archival staff error. This means that even if a document once existed, retrieving it may no longer be possible.
That said, if your ancestors’ documents do still exist, our genealogists will do everything they can to uncover them for you. In the process, you’ll also gain valuable insights into your family history. All documents we find on your behalf become your property and will be returned to you. - If the Polish document search succeeds, you will receive a payment link via email with the first installment of our fee for the Polish citizenship confirmation. Note that the family discount is subject to change based on the pricing policies in effect at the time any additional family members are added to the procedure.

If it turns out that some key details affecting your eligibility were wrong (for example, if your Polish ancestor actually lost or renounced Polish citizenship), and the authorities refuse to issue a certificate, we won’t be able to refund the first installment. This part of the fee covers the work we’ve already done based on the data you provided. - By choosing our service and making the payment, you accept these Terms of Service. The payment should be made securely using:
- Stripe or PayPal,
- credit card (processed by Stripe or PayPal),
- bank wire transfer.
Please note that the total amount due may be adjusted to include VAT, depending on your tax residency at the time of payment.
- We will ask you to send us the necessary documents (as originals or certified copies) so we can proceed with the Polish citizenship confirmation process and transcription of your birth or marriage certificates into the Polish civil registry.
- We prepare and send an application for confirmation of your Polish citizenship to the relevant Provincial office to get you your Polish citizenship certificate.
- We keep you regularly updated about the progress.
- Once your Polish citizenship certificate has been issued, you will receive a payment link for the second instalment, payable within 10 days.
- After we receive your payment (second instalment)* we send you a package that includes:
- your Polish citizenship certificate,
- all other documents (see the section IX),
- original documents you send us (see section IX),
- documents obtained from Polish archives on your behalf.
If any of the archive documents were issued in electronic form only, we will forward them to you as PDF files.

VIII. Polish Citizenship Confirmation – Fast Track for Document-Ready Cases
Once we have confirmed your eligibility for Polish citizenship by descent and you possess sufficient Polish documents, you can begin the official Polish citizenship confirmation procedure with our assistance.
- You receive an offer via email with the first instalment of our fee for our assistance in the procedure of confirmation of Polish citizenship by descent. You can then decide whether to proceed with the payment. You have one month to make this decision, as our offer will remain valid for this period. IX. Your Ready-to-Use Polish Passport Package
A Polish passport can only be obtained in person at any Polish consulate abroad or at a Voivodeship office (Urząd Wojewódzki) in Poland. To make this process as smooth as possible, we will send you a complete package containing all the necessary documents required for your passport application.
The package will be delivered to you via a registered shipment handled by a reputable international courier.
It includes:
- your Polish citizenship certificate,
- your registered birth and marriage certificates registered in the Polish office,
- your divorce decree recognized by Polish court (only if you were divorced before 2009 and the divorce took place outside of Poland),
- originals of documents we got from you (except your birth, marriage or divorce certificates, as well as death certificate of your spouse, or your mother’s birth certificate – which will be retained by Polish authority).
Please note that this package will only be sent after completing all required formal steps such as civil registration and, if applicable, divorce recognition — as described in Sections X, XI, and XII.
To receive your Polish passport you only have to take a picture of yourself, pay Polish passport official fee and book an appointment in any Polish consulate abroad or at a Voivodeship office (Urząd Wojewódzki) in Poland.
*Important – Some documents listed above may not be included if your case falls under one of the exceptions described in Section XI
X. Assistance with recognition of a foreign divorce decree
To successfully apply for a Polish passport, it is necessary that your current marital status is correctly recorded in the Polish civil registers. For divorced individuals, this means registering a foreign divorce decree in Poland.
Our service includes legal assistance with the recognition and registration of foreign divorce decrees in Poland. This allows the divorce to be officially noted in the Polish marriage certificate and updates the civil status of both spouses.
When necessary, this service is provided as an additional step during the Polish citizenship confirmation process.
Depending on the year and country in which the divorce decree was issued, one of the following procedures will apply:
- EU divorce decrees (except Denmark) issued after May 1, 2004 are subject to registration under EU law, without a need for separate proceedings before a Polish court;
- divorces issued in non-EU countries after July 1, 2009 or in EU countries before May 1, 2004, must be recognized by a Polish regional court (Sąd Okręgowy) through a formal procedure. Only once this judgment becomes final, the divorce can be registered in Poland. Please note that such court recognition procedures may take up to 12 months to complete.
As part of this service, we:
- assess the eligibility of your divorce decree for recognition or registration;
- prepare and submit relevant documents to the Polish civil registry or, if necessary, to the court;
- coordinate with the former spouse or their legal representative if their involvement is required.
This service is priced individually, based on the complexity of your divorce and the volume of documents involved.
At the offer stage, we will inform you of our legal service fee, and provide an estimate of the translation costs, which depend on the number of pages in your divorce documentation.
The payment for this service is split into two parts:
- the first instalment (covering our legal assistance) is usually paid together with the first instalment for the Polish citizenship confirmation procedure,
- the second instalment (covering the final translation costs) is due once the divorce recognition process is completed — even if that happens after your Polish citizenship is confirmed.
Additional costs may apply for court fees related to the translation and delivery of documents to your former spouse.
Please note that the total amount due may be adjusted to include VAT, depending on your tax residency at the time of payment.
* Important – In cases where your ex-spouse cannot or will not cooperate, and court recognition is required, we may not be able to complete the process
XI. Assistance with transcription of foreign civil status records
In order to obtain a Polish passport and PESEL number, you must first have a Polish civil status record (such as a birth or marriage certificate) that reflects your current and consistent personal details. This requires the transcription of your original foreign documents into the Polish civil registry.
Our service includes legal and formal support in preparing and submitting the required documents to the appropriate civil registry office (Urząd Stanu Cywilnego) in Poland. Acting under an authorization, we handle the transcription process on your behalf and ensure the proper and timely registration of:
- your birth certificate;
- your marriage certificate (if applicable – based on your and your spouse’s power of attorney);
- your divorce decrees (see section X);
- or your parent’s or spouse’s death certificate, if needed.
This transcription is usually carried out as part of the Polish citizenship confirmation process and is then included in the overall service fee. However, if you already have confirmed Polish citizenship and only need your foreign civil records transcribed, we offer this service independently, and in that case it is priced separately.
*Important – Transcription limitations you should know
As part of this service, we also assist in resolving minor discrepancies between your foreign documents – for example, slightly different spellings or missing data. However, there are certain situations that fall outside the scope of this service and which we do not handle. These include in particular:
- annotations regarding adoption in Polish civil records,
- gender change updates that require harmonization of civil status records,
- changes to a spouse’s personal data based on court rulings,
- establishing the content of a civil status record when reconstruction is impossible (under Article 40 of the Polish Civil Status Records Act),
- transcription of a birth certificate listing two mothers or two fathers,
- transcription of a marriage certificate involving same-sex spouses or civil partnerships.
These limitations result either from current legal restrictions in Poland or from the fact that such cases require a level of specialization and procedural involvement that falls outside the scope of our standard services. Our approach is not based on ideology or personal beliefs, but on objective legal and procedural boundaries.
We review your case with due diligence based on the documents you provide at each stage. If, at any point during the process, we identify a risk that these or other circumstances may affect the success of your Polish citizenship confirmation or subsequent passport application, we will inform you, explain the legal implications, and estimate the likelihood of success. You may then decide whether to proceed, understanding and accepting the potential risk.
In such cases, we continue our assistance in obtaining the citizenship certificate and you will be asked to pay the second installment after the certificate is issued — even if the passport application may later be unsuccessful for reasons beyond our control. We do not offer separate services related to the above-listed issues, nor do we represent clients in passport-related disputes with Polish consulates.
XII. Assistance with administrative change of first name or surname
Lexmotion offers support in the administrative procedure of changing your name or surname before the Polish civil registry authorities (Urząd Stanu Cywilnego). This service is available to individuals who hold Polish citizenship and wish to change their personal data due to personal, family, or documentary reasons — for example, to align their legal identity after many years spent abroad.
The change of name or surname is handled through an official application submitted to the appropriate civil registry office in Poland. Acting under a special power of attorney, we represent you throughout this process.
The expected processing time depends on the specific civil registry office handling the application — for example in Kraków it typically takes 2–3 months, while in Warsaw it may take around 4 months.
This service is offered on a case-by-case basis and is priced individually, depending on the complexity of your request and supporting documentation.
XIII. Key Limitations, Risks and Responsibilities
Please note, that:
- Our legal services concentrate on Polish citizenship law and only cover what is explicitly listed in this Terms of Service. Any information we might send you or make available on our website, regarding different fields of law (e.g. taxes, contract law, family law, inheritance law, real estate law) should not be treated as legal opinion, but merely general information that may vary considerably (or be inaccurate or untrue) in particular cases.
- The procedure of confirmation of Polish citizenship by descent may sometimes take longer than the average. It may also include additional costs. Please, refrain from making important decisions that can result in costs and damages dependent on obtaining Polish citizenship in time. Such events will not be dependent on us. We act with due diligence but operate only based on information provided by you.
- In some cases, it may be necessary to initiate a procedure for the recognition of a foreign court judgment. In such situations, the overall process may take longer.
- In some cases Polish authorities may interfere with the standard procedure of confirming Polish citizenship described above. They can for example:
- find an information or documents that prove that you or your Polish ancestor(s) renounced their Polish citizenship;
- recognize that your ancestor(s) declared another nationality (e.g. German, Soviet, Ukrainian, Russian, Belarusian, Lithuanian), especially if such a declaration occurred in a country with which Poland had signed a bilateral agreement on dual citizenship (e.g. the USSR, Hungary, Czechoslovakia, Bulgaria, Mongolia, or East Germany). This may result in the loss of Polish citizenship under the provisions of those agreements, even if there was no formal renunciation;
- request some additional documents confirming your or your ancestor(s) Polish citizenship. There might be various reasons for that, for example some of the documents delivered to them were issued without a legal basis.
- In some exceptional cases, instead of confirming Polish citizenship, it may be necessary to apply for the restoration of Polish citizenship. This applies in particular to individuals who lost Polish citizenship in a way that disqualifies them from the standard confirmation procedure, but who now meet the legal criteria for restoration.
If we identify this scenario at the sales stage, we will offer you the appropriate legal service from the outset. The price for the restoration procedure is fixed and depends on the selected currency.
However, if it turns out later during the confirmation procedure that the Voivodeship Office cannot confirm your Polish citizenship and officially states its loss (e.g. due to international agreements or renunciation), we will inform you of the legal basis and consequences. In such a case, the second installment of your fee will be increased accordingly, as the restoration process is priced differently from standard confirmation.
The steps we follow in such cases are essentially the same as those described throughout this Terms of Service. The only difference is that, in addition to the standard documents, we submit a separate application to the Ministry of the Interior and Administration (Ministerstwo Spraw Wewnętrznych i Administracji). This extends the overall process by approximately 3-4 additional months.
We will guide you through the entire process and clearly inform you of all legal and procedural implications before proceeding.Take special care:
- With post and couriers. If we do not receive a document due to post’s or courier’s fault, we will not be able to present it to the Polish authorities, which can influence their decision. Whenever we send documents to you, we commit to exercising due diligence in the selection of a reliable courier for their delivery. We cannot take responsibility for the courier’s fault in losing or destroying documents, but we will take all necessary measures to secure a package.
- When sending us scans of your documents. Avoid using instant messengers (e.g. WhatsApp, Facebook Messenger) to share sensitive files. If you send documents by email, double-check the recipient address before hitting “Send” and – ideally – protect the attachment with a password. If you need help with secure sending, just let us know – we’re happy to assist.
If you have any complaint regarding our services: - It can be submitted to welcome@lexmotion.eu. We scrutinize your complaint within 7 days from the date we receive it. You will receive our reply at the address from which you sent the complaint. If you do not agree with our reply, you can always use the court path to pursue your claims. You can also use the extrajudicial methods of complaint, in particular mediation and a permanent court of arbitration.

XIV. Right to Withdraw
You have the right to withdraw from our services without giving any reason and without incurring any costs, other than the cost of returning any documents, within 14 days from the day you entered into the contract with us.
The contract is considered concluded on the day you accept these Terms of Service.
To withdraw, simply let us know — you can send an email or a letter. You may (but don’t have to) use the sample withdrawal form we’ve provided here: LINK.
If you choose to withdraw, we will refund all payments made by you within 14 days of receiving your notice. We’ll use the same payment method you originally used, unless you ask us to use a different one.
Any documents you’ve sent to us will be returned within 14 days of your withdrawal notice. You’ll need to cover the cost of delivery.
*Important – if we have already fully completed the service within the 14-day withdrawal period, you lose the right to withdraw

By accepting these Terms of Service, you also enter into a contract for electronic service provision. This agreement lasts indefinitely but can be ended at any time — just send us an email or a letter saying you’d like to terminate it.

XVI. Final Notes on the Legal Side
All matters arising from these Terms of Service are governed by Polish law. However, choosing Polish law does not affect any rights you may have under the mandatory laws of your country of permanent residence.
